The discussions on the draft of national legislation on reporting irregularities in organisations are not ending. Dziennik Gazeta Prawna analysed the potential sanctions for failure to comply with the statutory requirements. The newspaper asked Dr. Beata Baran to comment on the issue.
In her comment, the expert from BKB pointed out that the current legal regulations do not specify who in the organisation may be held liable for the failure to implement systems for reporting irregularities and for the protection of whistleblowers. She emphasised that the maximum punishment of 3 years of imprisonment for lack of internal procedures seems very severe.
