Member States have little time to implement the Directive on the protection of whistleblowers. The European regulations will enter into force on December 17 2021.

It is worth preparing for the upcoming changes right now, as they will impose new obligations related to the implementation of whistleblowing systems and protecting whistleblowers on employers. The main regulations are discussed in the November issue of Poradnik Gazety Prawnej, which is wholly dedicated to issues related to whistleblowing. The publication was prepared by experts from our Law Form: dr Beata Baran, Kajetan Bartosiak, Magdalena Solich, Michał Bering, Łukasz Łaguna, and Bartosz Retkowski.

Our lawyers explained, among others:

  • What is a whistleblowing system?
  • Who is a whistleblower?
  • Who will be obliged to implement internal whistleblowing systems?

Additionally, the publication discusses:

  • Binding regulations on whistleblowing in the light of Polish law,
  • The scope and objectives of the Directive on the protection of whistleblowers,
  • The subject of reporting and the prerequisites for protecting whistleblowers,
  • Key new obligations of employers,
  • Ban on retaliation activities, means of supporting and protecting whistleblowers,
  • Termination of the employment contract with a whistleblower,
  • Potential claims of whistleblowers resulting from the employment relationship.

The details of the publication, including a sample fragment and table of contents, are available HERE.
