The District Court in Konin submitted a query to the Constitutional Tribunal concerning payment of sickness benefits following the death of an insured person. The query concerned whether the Sickness Benefit Act, which entitles the spouse of a deceased person to collect that benefit in a similar way to remuneration for work, are consistent with the Constitution of the Republic of Poland. The editorial staff of Dziennik Gazeta Prawna asked Professor Iwona Sierocka to comment on the matter. Professor Sierocka explained that taking into consideration the nature of sick pay and the principle of equality, the entitlement in question should be deemed constitutional.
