The Rzeczpospolita daily newspaper publishes a series of articles entitled “Harassment at the workplace”. The authors are expert lawyers from BKB, who analyse the main labour law regulations.

In the latest article in the series, Attorney Paweł Krzykowski reminded that, according to the existing jurisprudence, occasional instances of criticising the employee cannot be considered as harassment. He also explained that the employer has the right to assess the work critically, if the aim of the criticism is to ensure the realisation of a plan or proper work organisation. Mr Krzykowski also discussed the possibilities to pursue employee’s rights by workers who demonstrate that the employer violated their personal rights in an unlawful and intentional way, even if such action does not have the statutory properties of harassment.
