Pursuant to legal regulations, each employee who performs work is subject to social security. However, sometimes employers fail to register employees at the Social Security Office. The editorial team of Dziennik Gazeta Prawna analysed the issue of applying to be covered by social security for the period when no contributions were paid for the employee, e.g. while working in the black economy or based on a contract to perform a specific work.

The newspaper asked Attorney Kajetan Bartosiak to comment on the issue. Our expert reminded the readers that the title to social security emerges automatically at the moment of starting an employment relationship. He also emphasised that the Social Security Office is authorised to analyse the given employment relationship in order to detect whether it constituted a basis for a social security title.
